Subscription terms

Last updated: November 2026

Document undergoing legal review: this text is provided on a provisional basis and will be reviewed before the commercial launch of the service.

1. Purpose

These subscription terms (the "Terms") govern access to the Chiptune File service, published by Chiptune (the "Provider"), which enables a professional (the "Customer") to operate one or more websites selling engine remapping files under its own brand (a "File").

The service is reserved for professionals. By subscribing, the Customer declares that it is acting in the course of its business; consumer protection law does not apply.

2. Account and access

Access to the service is exclusively via a ChiptunePRO account. The Customer is responsible for keeping its login credentials confidential and for any action carried out from its account or by the team members it invites.

3. Plans and prices

Each File is subject to a separate monthly subscription. Two plans are offered:

  • "Commission" plan: €100 per month, plus a 5% commission on each payment collected by the File;
  • "Flat" plan: €300 per month, with no commission on payments.

4. Subscription payment

The subscription is payable monthly in advance by bank card or any other method offered by Stripe. It renews automatically. A change of plan takes effect immediately and is invoiced pro rata for the current period.

If a payment fails, the File remains online during the retry period provided by Stripe; if the situation is not remedied, the subscription ends and the File is taken offline.

5. Payments and commission

Payments from the File’s customers are collected directly into the Customer’s Stripe Connect account, opened in its name. The Customer is the seller: it sets its prices, issues invoices in its own name and is solely responsible for its tax obligations (including VAT) and its sales.

When the "Commission" plan is active at the time of a payment, the 5% commission is deducted automatically from that payment when it is collected.

Stripe processing fees are borne by the Customer’s connected account, not by the Provider.

In the event of a full or partial refund of a payment to a customer of the File, the commission already deducted is not refunded. Disputes (chargebacks) and their fees are borne by the Customer’s connected account.

6. Customer obligations

The Customer undertakes to use the service in accordance with the law, in particular regarding the protection of its own customers’ personal data, invoicing and the regulations applicable to vehicle modifications. It is solely responsible for the content, prices, legal texts and files it publishes or delivers through its File.

The Provider may suspend a File in the event of a serious breach, fraudulent use or non-payment, after informing the Customer where circumstances allow.

7. Availability and liability

The Provider uses reasonable means to ensure the availability of the service, without guaranteeing that it will be uninterrupted (maintenance, incidents, third-party suppliers). Its liability is limited to direct damage and capped at the amount of subscriptions paid by the Customer over the previous three months.

8. Cancellation

The Customer may cancel a File’s subscription at any time from the manager. Cancellation takes effect at the end of the current monthly period; no period already started is refunded. The Customer may withdraw the cancellation until the period has ended.

9. Data at the end of the subscription

At the end of the subscription, the File is taken offline and its data is kept for 90 days, during which the Customer may resubscribe or export its data. After this period, the File’s data is permanently deleted, subject to legal retention obligations.

10. Changes to the terms

The Provider may amend these Terms and its prices. Any substantial change is notified to the Customer at least 30 days before it takes effect; the Customer may cancel before that date if it does not accept the change.

11. Governing law

These Terms are governed by French law. Failing an amicable settlement, any dispute shall fall within the jurisdiction of the competent courts for the Provider’s registered office.
